Effective Contract Labour Management

  • PREFACE

Contract labour or labour outsourcing has become a necessity in today’s competitive environment. In order to remain competitive, efficient and cost effective, it has become imperative for an employer to restructure the organization, modernize the technology, reduce regular manpower and rely more and more on contract labour. In order to regulate the service conditions and ensure social security measures for contract labour, the Contract Labour (Regulation and Abolition) Act, 1970 and other central and state legislation and related rules have been made. The non-compliance of statutory obligations may lead to the conflicts between the employer and contract employee and in some cases matters may also go to the High Courts and the Supreme Court of India with serious business implications including the liability on the principal employer.

As non-compliance of statutory obligations due to ignorance of law is no excuse, it becomes essential for all those who are involved in hiring and dealing with contract labour or labour outsourcing to have basic knowledge about relevant labour laws. They should also possess necessary skills to deal with legal and regulatory issues and avoid conflicts as well as unnecessary litigation in the greater interest of the organisations. They need to have clear understanding of the implications of court orders which are sometimes complicated and contradictory. As the knowledge of the legal issues in effective contract labour management may help in saving the organisations from unnecessary litigation and personal/institutional liability, it becomes imperative for managers/ officers/ contractors and the principal employers to have necessary knowledge and understanding of constitutional mandate, statutory obligations and the ramifications of judicial pronouncements so as to avoid legal risks and manage the contract labour in their organisations more effectively.
